It depends on if the virtual school is a private school or public charter school. If it is a public charter school they are bound by IDEA, Section 504 and ADA. If it is a private school they are not bound by IDEA, they are only bound by Section 504 if they receive federal money and they are bound by ADA.

I'm not sure what the original question was here, but I have one that is pertinent to this subject line. When we first began middle school, things de-escalated quickly. I began the enrollment process for an online public school, and one of the documents they required was her IEP. So I know that special education is something that they can and will work with. My question though is this ... does anyone have any experience in this educational setting?

Public school has not worked out for her since the beginning middle school. No surprise there. She is currently in a therapeutic school, which I think is a good placement. Two things though: 1) she is only there on a trial basis, until the "fit" is assessed by the school staff and the IEP team; 2) she has not been going for about the last week and a half (started with the flu, but she has refused to go back since). She is begging me for home school (again). My concern about home schooling is primarily the 24/7 time together. She needs to be socialized independent of me, and I will need to work - even if part time, not to mention having some "sanity" time of my own. The website I'm looking at now discusses field trips and social experiences, and I have put in a request to talk to another parent of a currently enrolled child. But I'm sure that parent will not have the special education take on her experience.

I thought maybe I'd find someone here who had some thoughts on this. Thanks :)
